How does an objection procedure against the tax authorities work?
An objection procedure is a procedure before the civil court, whereby the debtor is obliged to engage a lawyer. The lawyer summons the recipient. This writ of summons complains about the enforcement of a writ of execution. Because this starts a “normal” civil procedure, other civil matters can of course also be addressed.
For example, if the debtor is of the opinion that the recipient has acted unlawfully and is liable for damages for this, this can also be raised in the opposition proceedings. In the opposition procedure, you can also ask for:
- Removal of seizures;
- Refund of amounts paid / settled;
- The obligation to defer payment during the objection and appeal procedure.
The summons is served by a bailiff’s writ on the recipient of the tax authorities. This starts the opposition procedure and the suspending effect is activated. This suspensive effect means that the collection by the tax authorities, until the court has ruled on whether the objection has been lodged correctly, may not proceed with the execution of his writ of execution.
