Your Wajong benefit will be terminated by the UWV if the UWV determines that you have no permanent work capacity. You can obtain Wajong from the UWV if you are unable to work now and in the future due to your illness or disability. This is called permanent no energy.
To assess whether you have capacity to work, the UWV checks whether you meet these 4 criteria:
- You can perform a task in a work organization.
- You have basic employee skills.
- You can work at least 1 consecutive hour.
- You are taxable for at least 4 hours a day.
The UWV determines this after an insurance medical and sometimes an occupational health check. You will receive a written decision of this from the UWV.
Are you considering the objection period?
You must then lodge an objection within 6 weeks of the date of the decision. The objection usually concerns the content of the insurance medical and occupational expert parts of the Wajong assessment by the UWV or the resulting disability percentage awarded.
The objection mainly concerns the content of the decision, but can also concern whether the UWV could reasonably have reached this decision.
Reassessment in objection by UWV
After submitting your notice of objection, the situation will be reassessed by other employees of the UWV. A so-called objection insurance doctor and objection labor expert will reassess your file and respond to the arguments submitted by us.
If the objection is rejected by the UWV, you can still appeal to the administrative judge of the court. As the last judge, an appeal can be lodged with the Central Board of Appeal.
