Legal assistance insurance and your right to a free choice of lawyer
Do you have legal assistance insurance with, for example, DAS, ARAG or Interpolis? You do not have to be satisfied with ‘legal assistance in kind’. It follows from European law that you are free to choose in proceedings who you may assist as a lawyer. This is true in almost all types of cases. In the case DAS / Sneller (ECJ 7 November 2013, C-442/12), the Court of Justice has ruled confirmed . You can choose your lawyer yourself and you cannot be unfairly limited by your legal expenses insurance such as DAS, ARAG or Interpolis. Via this external link You can read more about this.
Check your policy to see if you are entitled to free choice of lawyer through your legal expenses insurance.
You can choose an expert lawyer yourself and you do not have to settle for the often less experienced lawyer from your legal assistance insurer. This is an absolute right, which the insurer cannot refuse you if there are (imminent) legal proceedings. Do you want to know more? The Consumentenbond has written an extensive article about the how and what of free lawyer choice. Here you will also find an overview of the various legal expenses insurers.
